Cette classification a depuis \u00e9t\u00e9 revue et annul\u00e9e dans un arr\u00eat rendu par le Tribunal de l\u2019Union europ\u00e9enne le 22 novembre 2022.  <\/p>\n<p>Les principales raisons de l\u2019annulation \u00e9taient qu\u2019une erreur avait \u00e9t\u00e9 commise dans l\u2019\u00e9valuation de la fiabilit\u00e9 et de l\u2019acceptabilit\u00e9 de l\u2019\u00e9tude sur laquelle la classification \u00e9tait bas\u00e9e, et qu\u2019une classification ne peut s\u2019appliquer qu\u2019\u00e0 une substance qui a la propri\u00e9t\u00e9 intrins\u00e8que de causer le cancer. Par exemple, l\u2019UE a tent\u00e9 de limiter la classification aux poudres et l\u2019entr\u00e9e pour le TiO<sub>2<\/sub> comprend le texte suivant \u00ab sous forme de poudre contenant 1 % ou plus de particules d\u2019un diam\u00e8tre a\u00e9rodynamique \u2264 10 \u03bcm \u00bb.<\/p>\n<p>Cela signifie que si le TiO<sub>2<\/sub> ou les m\u00e9langes contenant du TiO<sub>2<\/sub> ne se pr\u00e9sentent pas sous cette forme sp\u00e9cifique, la classification ne s\u2019applique pas. Elle est \u00e9galement ambigu\u00eb et peut faire l\u2019objet de multiples interpr\u00e9tations. Par exemple, les m\u00e9langes liquides et certains m\u00e9langes solides ne sont pas class\u00e9s, mais, du fait de la classification, des avertissements et des \u00e9tiquettes sp\u00e9cifiques doivent \u00eatre appos\u00e9s sur ceux qui contiennent plus de 1 % de TiO<sub>2<\/sub>.<\/p>\n<p>Pour r\u00e9pondre \u00e0 ces questions, l\u2019AMDT a \u00e9labor\u00e9 une interpr\u00e9tation compl\u00e8te du champ d\u2019application et de la mise en \u0153uvre afin d\u2019aider les fabricants, les importateurs et les utilisateurs en aval \u00e0 appliquer cette classification. En l\u2019absence de m\u00e9thode officiellement d\u00e9sign\u00e9e, plusieurs qualit\u00e9s de TiO<sub>2<\/sub> ont \u00e9t\u00e9 test\u00e9es selon des m\u00e9thodes d\u2019essai internationalement reconnues pour l\u2019empoussi\u00e8rement. Les r\u00e9sultats indiquent que ces m\u00e9thodes pr\u00e9sentent une variabilit\u00e9 minimale et conviennent \u00e0 cette application.<\/p>\n<p>Les donn\u00e9es montrent syst\u00e9matiquement que la grande majorit\u00e9 des qualit\u00e9s de TiO<sub>2<\/sub> ne r\u00e9pondent pas aux crit\u00e8res de classification. M\u00eame l\u2019UE a soulign\u00e9 dans la classification que le danger suspect\u00e9 ne pourrait probablement se produire que si des poussi\u00e8res telles que la poudre de TiO<sub>2<\/sub><br \/>sont inhal\u00e9es \u00e0 des concentrations extr\u00eamement \u00e9lev\u00e9es sur une longue p\u00e9riode de temps, provoquant ainsi une atteinte des poumons. La classification des substances dans le cadre du r\u00e8glement CLP est purement bas\u00e9e sur les dangers et ne refl\u00e8te pas les risques r\u00e9els li\u00e9s \u00e0 l\u2019utilisation d\u2019une substance.
