A US Federal Court has ruled that California titanium dioxide warning requirement is not-scientifically justified
On 12 August 2025, a US federal court issued a permanent injunction preventing California from enforcing Proposition 65 warning requirements for certain forms of titanium dioxide (TiO₂) used in cosmetics and personal care products in a case brought by the US Personal Care Products Council (PCPC).
Court’s Findings
The court ruled that the mandated warning was misleading because it implied a proven risk not supported by scientific consensus. Regulatory authorities, including the US Food and Drug Administration (FDA) and European agencies, have not identified a causal link between cosmetic use of TiO₂ and health outcomes.
Outcome
The court’s decision permanently prevents California from bringing new Proposition 65 enforcement cases for TiO₂ in cosmetics and removes the requirement for companies to apply such warnings going forward. The judgment also underlines that mandatory product warnings must be based on clear and balanced scientific evidence.
