TDMA statement on European Court of Justice in landmark ruling in titanium dioxide case

The Titanium Dioxide Manufacturers Association (TDMA) welcomes the European Court of Justice’s (ECJ) decision to uphold the General Court’s annulment of the classification of certain forms of titanium dioxide (TiO2) in the joined cases C‑71/23 P and C‑82/23 P on Friday, 01 August 2025.

This judgement means that the classification of TiO2 has been overturned, and its entirety in the harmonised list of Classification, Labelling and Packaging Regulations (CLP) Annex VI will be removed once the EU Commission has completed a multi-step regulatory process in the coming months.

The TDMA regards this decision as a recognition of the importance of robust and reliable scientific evidence to support regulatory classification decisions of EU regulators. It is also seen as an important clarification of the interpretation of the existing regulatory framework.

The TDMA remains committed to supporting science-based regulatory actions that are proportionate to both the hazard and the risk and continues to invest in generating robust scientific data to further confirm the safety of TiO2.
